I think that it won't count as his second in the NFL, because he got caught before he was an NFL athlete. A DUI maybe will end up in a 1 game suspension, though. Especially an aggravated one.

Wow...I just can't understand how these guys can't take the simple step to avoid something so stupid. I realize that people screw up, and nobody is perfect, but this type thing just doesn't make sense. On top of that there are no real consequences for the NFL athlete. Teams rarely do or say anything about it and the fines/SR-22 insurance aren't anything that cause any sort of discomfort for the offending player. The penalties involved with a DUI are back-breaking to an average citizen and in many cases can even result in being terminated from their job. The NFL player simply resorts to something that should have been done in the first place: hiring a driver when they go out for the evening. Having said that, this kid is on the road to ruin IMO. Or worse, he'll end up injuring or killing somebody.
