Federal court rules Obamacare unconstitutional

Recommended Posts

huge win!

essentially the individual mandate and forcing insurance companies to charge the same premiums for patients with preexisting conditions and healthy patients was ruled unconstitutional.

the justice department did defend some of obamacare, like the expansion of medicaid to poverty stricken families and employer mandates, but I believe ruling part of the bill unconstitutional would invalidate the rest.

likely to be appealed and will probably end up in the supreme court (won't really matter though given the 5-4 majority)

maybe now trump can focus on a healthcare plan that will actually cater to the middle class, something obama clearly missed on with the ACA

Quote

A federal judge in Texas has ruled the Affordable Care Act unconstitutional, finding that the law cannot stand now that Congress has rolled back the mandate that everyone carry health insurance or pay a fine.

The new ruling poses a significant threat to the Affordable Care Act’s most popular and most sweeping health insurance reforms. If affirmed at higher courts, it could roll back Obamacare’s ban on pre-existing conditions. Insurers would once again be able to charge sick patients higher premiums.

As someone who’s wife has a couple of “pre-existing conditions” fug them and fug anyone that backs that bullshit.

by preexisting conditions do you mean something hereditary or genetic that was out of her control or simply high blood pressure, diabetes, heart disease, AIDS/HIV, alcoholism, obesity, etc.?

if the latter, fug you for making middle class citizens shoulder the bill for conditions that were caused by none other than poor lifestyle choices and bad eating habits.

I didn't agree with all of Obamacare but who's this a huge win for?  It's a huge loss for fugtards like you with no job with benefits.

which is why i said I don't blame you if it's conditions out of her control (although hashimodos and renal cancer can also be caused by lifestyle choices, but it could be genetic as well)

that's why we need a complete overhaul of obamacare, b/c while your wife was getting the coverage she needed, middle class citizens were stuck paying outrageously high premiums b/c federal subsidies paid to insurance companies wasn't nearly enough to cover patients with preexisting conditions like your wife.

we gotta tackle the culprits here, and that's pharmaceutical companies, medical device manufacturers, hospitals, and other price gougers who are charging ridiculous amounts of money for simple things like antibiotics, colonoscopies, riding in an ambulance, getting a stent put in, etc.

I know trump signed a bill banning gag clauses, but more needs to be done.

it's a huge win b/c it completely eliminates the individual mandate. fug obama for forcing me to either pay a huge fine at the end of the year or sign up for one of his ridiculously high government exchange plans with $10,000 deductibles and co pays through the roof.

fun fact....not everyone who suffers from the later is just a lazy sloth.

also, you seem to be doing cartwheels for what one judge ruled.  You have dismissed a lot of rulings the past couple years.  You know with claims of wild libtard rulings just meant to stick it to Trump.  This easily could just be an example of the opposite.  Just a random judge throwing Trump a favor and will be meaningless.  Far from over.

Only problem I have with the individual mandate is it was too light on those that didn’t carry insurance.  Penalty wasn’t harsh enough.  Every should have insurance.   And yeah, WE pay for all the idiots that don’t have insurance.  Fug that

You didn’t have to pay a huge fine.  Which was a fundemental problem with Obamacare.

Premiums are high for lots of reasons.  People opting to pay the fine and the nation not being all in, literal sabotage so the premiums would be high, etc.  Obamacare was flawed.  It was at least a start in the right direction.

and we the people, pay for all the folks who choose not to be insured.  So if you don’t have insurance....we end up paying for your ass

you can be genetically predisposed to having a higher chance of developing certain conditions such as HBP and heart disease through no fault of your own and regardless of your lifestyle choices / eating habits.
