  1. This. If she was confident she would win the case, then she would have pursued it. There would also have been a civil suit that followed (REGARDLESS OF THE VERDICT in criminal court) where she would get paid anyways. The DA has nothing to lose making a claim they had "sufficient evidence" that there was a settlement. That statement will never be looked into any further by anyone in the legal system. It is basically the DA just trying to save face in a situation where they clearly had no case and drug it out much longer than necessary (in my opinion). I'm not a lawyer.
