What is ridiculous about it?  He chose to have a bench trial and the judge felt there was enough evidence to convict him.  He then chose to move to a jury trial.  I can understand claims that the judge's initial ruling was flawed, but the law/system functioned as it should.

 He didnt (choose) a bench trial. It was a misdemeanor...in NC...where you cant have a trial by jury until you've been found guilty at a bench trial.
