Even if the story were completely true, would it actually be a crime? If not, a civil lawsuit would have been the only option. Can't say I'm familiar with Texas law and don't know if we have anyone on here who is.

Text of the complaint would seem to indicate there are messages documenting communication between the parties. If he indeed texted and apology for his behavior and she has that message, that might not look good. -
