That's getting to be an oft used headline.

A felony DWI? Refusal to blow automatically (into an intoxilyzer) gives reasonable doubt of sobriety in NC, and is an automatic charge of DWI based on such. However, it is a pending misdemeanor that can be thrown out based on a more reliable breathalyzer and an even more reliable blood test.

You still have to go to court, but you are only charged for misdemeanor suspicion based on said refusal unless the arresting officer mandates a search warrant blood test.

I am speaking strictly from a voluntary ride-along with an incredibly nice CMPD officer and his openness to NC laws and how they operate.

Either Florida laws are much more severe, or there is something more to this.
