I got my first speeding ticket in Charlotte...

Get a copy of your driving record for the last 3 years.

 

Show up to court early on your court date and get in line to see the magistrate.

 

The magistrate will lower your offense to 9 over rather than 14.  No Points.

 

This is exactly what happened to me.  Magistrate simply stamped my ticket and sent me to the cashier.

 

When I got my ticket the cop took 3 minutes writing me up then 10 minutes telling me what to do to get it reduced.

 

 

9 mph over the speed limit is in a 55 mph zone or higher is no points? Pretty sure it is 2 pts which would raise your insurance about 40%. You may be surprised when your renewal comes up.

 

I just went through this exact scenario a couple months ago. I would hire a lawyer and get a prayer for judgement or improper equipment. Much cheaper in the long run and not having to spend half a morning in court is just an added bonus.

why don't you just sue the cop for wasting your time and a few other bullshit charges at the same time?

 

I understand this might cost you some money in the long run...but guess what....do the crime, do the time!

 

I can't for the life of me understand all the responses to get an attorney?  Sure, go and take it to the magistrate and probably you'll get it reduced, no problem with that.

 

but an attorney?  you've already admitted that poo happens and haven't stated any reasons why you shouldn't have been ticketed....

 

rant over...but I just don't get it

Not sure if you are being sarcastic or not.

 

Hire the attorney to not get the insurance points and 7 years of increased insurance rates.

 

Still pay the fine for speeding....because he was speeding.

makes sense then...here they are latched together...pay the fine, you get the points!  People fight here to have the whole infraction reduced which includes the $$ and the points.

I am with Madhatter on this one. No one is saying not to pay the fine for the infraction but why pay the higher insurance rates if you don't have to?

 

Insurance companies always do what is in the best financial interest for them when it comes to individuals so why shouldn't the individual do the same? They use all kinds of data mining like running credit reports, medical reports, etc. just to make sure they will profit from you. The minute they realize they can make a profit off you, they will drop you like a bad habit.

For those wondering why/how it was a 69 in a 55, the sheriff's deputy (yeah) said he clocked me going 83 in a 55 and knocked it down to 69. Should also mention he was apparently camping out about 15 feet past where the speed limit goes from 65 to 55. Regardless I just didn't think I was going that fast, but as I said in the OP, it happens to many of us at some point.

I never said I would refuse to pay it. Clearly, if I'm posting it on a message board I'm not exactly saying "Waaa, he made up the charges, I'm not paying!"

 

I was just asking for some advice and letting people know what happened, so they could give more informed advice.

This happened 4 years ago.

 

No Insurance increase.

Attorney usually does NOT get the charges dropped.  They will 99% of the time get the speeding infraction reduced to an "improper equipment" violation....which seems ridiculous, but that is what they do.

 

You pay a fine almost identical to the speeding violation, but since it is a non-moving violation there are no insurance or license points given.
