Hardy's guilt or innocence will be determined at his upcoming jury trial because the previous ruling has been negated.

Also....Rivera, Gettleman, and Richardson haven't publically made their stance known concerning Hardy. There has been plenty of speculation reported by media and insider types but it's still just speculation...which ya know doesn't make it more than a rumor or presumption.
