Exempt List

They put him on the exempt list instead of cutting him because there's still a chance he plays later this year if he wins his appeal.  What a boost that would be for the team that's likely to be in the midst of a playoff push late in the season.  They still have to pay him if they cut him or not, why not roll the dice and hope he plays later this year.

So you think that if he's found guilty he will still play football this season?

I have a hard time believing he plays another snap with a guilty verdict.

Gotta factor brutality in here.

This is completely different than what Rice did.  Even in a worst case scenario for Hardy, he didn't BEAT a woman.  At worst, he threatened and roughed up a woman.  Yes they are both forms of domestic violence, but they are on drastically different levels and punishment should fit accordingly.

Odds are even if found guilty his games on the exempt list will count as suspended games and he'll have to pay the 4.6 million he earned during those 6 games.

If he's found guilty he gets a 60 day sentence doesn't he?

Not necessarily.

This is a trial de novo (or however you spell it).  His sentence could be more or less.  In the eyes of the law his bench trial had never happened, so anything could happen in this new trial.

I'm not expert in law so the possibility does exist that there are particular laws in place that "lock in" the bench trial sentencing.  I have yet to see anyone touch on that particular aspect of it.  He might also not go to jail right away and it's also entirely possible (in fact, i'd almost say likely) his court date gets pushed back into next year.

The thing that sux in the hardy case is the docket is full the week of his planed trial.

Then the court will break the following week until the new year.

If they don't get it done that week then all of this is irrelevant.

Also, no chance in moving the trial up, Hardy doesn't have a good enough reason and the court has other cases much older in the docket to try.
