Legal-type question

Lets say someone you used to love but now hate has a NC drivers license. Lets say said person is pulled over in SC for DWI. Said person refuses to submit to BAC testing. I believe under SC 56-5-2950 their license is automatically suspended for 90 days because of their refusal.

Does anyone know if this would affect their driving priviledge in North Carolina??

Also, if anyone has a fool proof method of opening an envelope without detection please let me know. :)

Well my friend you are in luck. I had this happen to me in 1997. Plead no contest and NC cant do a damn thing. That is unless the laws have changed.

Didn't happen to me. Happened to my ex. I really don't give a crap what happens to her. I think this "might" have been her second offense. I know she's had her license suspended in SC for speeding, then got another ticket for driving without a license.

I'm worried about my kids, and I"m going to consult with an atty to see if I can sue for full custody.

I'm pretty sure a suspended license is a suspended license, there, here or anywhere.

As far as the custody stuff...it could get factored in to the decision of the judge, but I'd be VERY careful how you acquire the evidence, if you get my drift.

Yeah. My daughter calls me one day at 2PM, very scared, didn't know where mom was Um, in jail! From about midnight one night until 5pm the next day, my kids were on their own and thought she could have been dead. stupid bitch. I'll see what lawyer says next week.

I was kidding about the envelope. What I can see thru the little window tells me enough, that she refused test. I looked up the statute and saw what the punishment was. Might be more if they factor in her speeding (and the other DWI she got about 5 years ago...if she was convicted that is).

Anyway, thanks everyone, life is a long road and all that good poo.

Which state has jurisdiction over child custody?

I beat the odds in SC and got custody of my children. It can be done on the grounds of negligence and child endangerment (leaving them un supervised)..... and never hurts if you can prove she frequents the company of some rather lewd peeps too.

Assumption that "mom" is always better suited to raise children is pure BS. Good Luck.
