This thread has nothing to do with whether marijuana should be legal or not. That is irrelevant to what happened here. Someone could just as easily send a box full of child pornography to his property and have him arrested for that.

This post is irrelevant to what happened here.

What's so hard to understand? It's not about marijuana, it's about him getting in trouble for something illegal being on his property without him knowing about it. Saying marijuana should be legal is ignoring the bigger issue of him being framed and charged with something without there being any proof he knew about it or ordered the item.

If marijuana was legal, whoever framed him would not have sent him a box full of marijuana. Thus saying marijuana should be legal is ignoring the issue and engaging in absurd ideas.

It would be like me saying we should have a society with no laws. That's not exactly the point here.

That happens all the time, I know someone who works at usps and they report it to the police and set it up. UPS and Fedex do it too. And those lawyer fees are gonna be pretty fuggin expensive probably looking at 5-10 grand.

You're operating on the assumption that he was indeed framed. That's something incredibly hard to stand beside given the limited amount of information we have both about this situation and the OP IRL.

If he WASN'T framed, then saying "this is an example of why marijuana should be legal" could be valid, because if someone sent 3 pounds of weed and almost 2 oz of hash and marijuana was legal, we wouldn't be sitting here having this discussion.

Edit, unrelated point: But, if the police had a warrant for the package, why would the package have been allowed to leave the sorting facility it went through to get to his house?

Because my name wasn't on the package and the only way to actually arrest anyone for it was to show me receiving the package.

OK. I read the whole thread and have determined Floppin is guilty as hell. Sorry Floppin just going with gut instinct.

lol, that was my instinct too. If someone wanted to frame you they would have saved the 50g's of hash and just sent the weed.

Yeah, it was unopened and I had written Return To Sender in huge sharpie all over the fugging thing.

you're fine. trust me. there is no intent on your part.

no paraphernalia in the house.

any lawyer could get the tackle box thrown out because there are 10,000 other people in the world with the same one I'm sure, so all those people are guilty too?

You wrote return to sender and never actually "accepted" the package, so they have no proof that you planned on keeping it or even knew what it was.

there is no intent whatsoever in this case.

And even if you DID know there was weed in it, what kind of person writes return to sender on a box of weed and hash and then sends it back? Thats' a lot of money lost right thar!

I have a feeling it will be thrown out fairly quickly. Only thing that sucks is you will have to pay lawyer fees, but that's worth 4 felonies off your record.

Also, you need to blow this poo up. Go to the news or something.

I dont' think it was a setup. I mean it's possible. I think it's far more likely that some retard just put the wrong address on the box.

Yea thats possible. Back in the day some guys i knew were supposed to be getting some shrooms and they ended up finding it on the front porch of a church 2 blocks away. Crazy coincidence though if it wasnt yours
