NFL OKs New Conduct Policy

North Carolina has self initiated arrest warrants by citizens.

 

If I want to charge someone with a misdemeanor crime I just need to go to the magistrate and establish probable cause (without any real investigation) and they will issue an arrest warrant.

 

It would then be my responsibility to prove my case in court.

 

It is a formal charge and will be on your record even if the charges are ultimately dropped.

Not if it is a misdemeanor. Which for instance Greg Hardy's charge was a misdemeanor. In those cases the victim has to prove their case in court like a prosecutor would

Being arrested does not mean you'll be charged. You'll only be charged if after your arrest there is sufficient evidence to prosecute you. If you are charged then the NFL policy comes into play.

I see this policy as no change whatsoever from what was done this year. The only difference is, they put in an "independent" investigator/commission so the heat falls on someone other than Goodell.

 

The commissioner's office has become a joke. It's time for the NFLPA to show some balls.

In all honesty, with all the law suits by the players that beat the poo out of there wives and win there case its not wonder they are doing this. WTF do you want the NFL to do, they cant suspend players for conduct anymore yet if they let them off light the media has a field day.

Being arrested does not mean you'll be charged. You'll only be charged if after your arrest there is sufficient evidence to prosecute you. If you are charged then the NFL policy comes into play.

 

If I want to file a criminal complaint for misdemeanor assault, all I have to do is go to the magistrate and establish some sort of probable cause, there is no investigation, but they will issue a warrant and you will be formally charged.  That charge will be on your record even if the charges are ultimately dropped

 

It is then then my responsibility to present my case in court.

 

You are thinking about major felonies.  Most of these domestic violence charges, are misdemeanors.

Again an arrest means nothing. In most cases it's meant to help police get hold of parties involved in a case for gathering evidence. You can only be formally charged when they feel there is enough evidence. After all, Ray McDonald was arrested for the same offense but NOT formally charged due to lack of evidence.

You can be CHARGED based off of probable cause by a magistrate and then it so the responsibility of the person filing the charges to prove their case in court.

It is a formal charge that remains on your record even if they are dropped by the accuser at a later date unless you pay to have them expunged

i agree 100%.however,an accusation alone can be sufficent enough to establish probable cause.

leme get this straight, all a player has to do to get paid for the season and do nothing is have someone accuse them of rape, wait for the trial a year later, collect their pay checks and then have said person drop the case.

Exactly what I thought first place. It COULD attract players to have someone accuse them and collect checks for staying home or hanging out at the beach. Stupid idea in my eyes, just see the Hardy situation.
