Civil lawsuit against J. Winston

The timing of this suit is obviously meant as a hit to Winston's draft status. I'd hate it if the Bucs don't take him. I'm looking forward to Cam getting up for Winston every game to payback FSU beating Auburn in the BCS in 2014.

Winston's days of being big man on campus and getting the kid-glove treatment by the local authorities is over. 

 

From now on, his life will be continuously examined under a national microscope by groups with all sorts of agendas.

she immediately called what happened that night rape,

and to this day, he maintains that it was rape...

 

Things that goes against her:

 

Winston maintains it was not rape and to this day maintains it was not rape

Casher maintains it was not rape and to this day maintains it was not rape

Darby maintains it was not rape and to this day maintains it was not rape

Kinsmans own friends story matches Winston (and Casher and Darby)

Toxicology Reports (done by Tallahassee and UF) matches Winston and not Kinsman

The BAC Report matches Winston and not Kinsman

The Rape Kit done matches Winston and not Kinsman

Her own story keeps changing (and Kinsman is the ONLY person who keeps changing her story)

Her cell phone records indicates that Kinsman was seeking to have friends join her, despite you know, she is supposed to be drugged and being rape during this time

She jumped on the back of her alleged rapist scooter and pointed him in the direction of her dorm

Kinsman decided it was okay to stay in the same classroom all semester as the man who violently raped her

Kinsman decided to stay at the same school until November, 2013 as the man who violently raped her

You don't have to prove much in civil court. If can convince the judge or jury that it probably happened, that is all you need.

She could not even meet a lower standard in her Student Code of Conduct hearing rigged for her, and with a former FL Supreme Court justice that she picked.

If I was the woman trying to sue I would try to wait until after his contract signing so I could get more money.

I wonder if he's found guilty if the NFL will take some disciplinary action. I mean they lost their poo when they benched a legally innocent man for the entire season, how is it gonna look if a convicted rapist is drafted #1 and the NFL does nothing. The women's groups who blasted the NFL in the wake of Ray rice, Ray McDonald and Greg hardy will have an absolute field day.

Great point! If they want to be consistent then they have to take action or at least do what they did with the hardy case and demand that they are given access to the case files. Otherwise they are going right back to their old ways and deserved to be shredded by the media.

Her lawyer may feel that Winston will pay her off to drop the charges, so that it doesn't hurt his draft status,something i don't see happening.

Playing devil's advocate here:

 

She claims the entire case was mishandled by the tallahassee police department and that they strong armed her into not pressing charges or going after Winston because it was a "football town"

 

She could have asked her friends to join her in order help get her out of the situation

 

Just because she stayed in the same class as the guy who raped her doesn't mean she wasn't. She could have needed the class in order to advance her degree and tried to power through it. 

 

So because she got raped she should have just left the school? That's just a terrible argument for her lying. She eventually left because she got so many death threats she felt unsafe. 

 

I can understand every argument you made accept for the last two. Those last two are irrelevant.
