That was the total tipout for a week. Not a day. If you made $1,000 before tax and they tip out your $200 That's 20% of your check tipped out before taxes, then taxes come in. She worked 5 days, that's a day worked for free. Not sure what you are confused about honestly.

No I had no idea they paid 2 bucks an hour to servers it's a yuge secret. Some people don't tip no matter what so your comment is moronic. Matter of fact lots more people don't tip or tip a couple of dollars. To reverse your stupid comment. If you are good at your job you should be rewarded - But since the laws around this are idiotic you don't usually get back what you put out.

Funny how the rest of the world manages to move forward through time just fine without the idiotic and anti worker idea of tips.

Agreed and you can tell Snake is one of those people. "Serve me bitch I had to wait one whole minute on my drank to be refilled" *throws a dime on the floor*

Also a lot of the servers that do end up serving poorly do so because they just got 3 tables in a row of no tips or 2 bucks to go along with their TWO DOLLAR HOURLY WAGE(can't forget that beastly fact)

I worked in customer service(not food) while using my GI Bill to get my BA in Computer Engineering and had to deal with POS MFers and understand completely how the American customer is. Then the stories from the store...easy to see how people get jaded and have a anti person disposition.

I say American customer b/c when I was stationed in Japan it wasn't even close to being like that.

In my experience, many many people think they can (and should) treat someone like poo if they are that person’s customer.

Doesnt matter if you are wait staff or a $500/hr vendor. People will treat you like poo because they think you’re just supposed to take it.

Total power trip and often comes from people who are abused themselves by their employers.

Crap rolls downhill. I see it everyday.

Because what you are saying isn't making any sense to me.  I don't understand the problem.

Every server in any restaurant (or just about, unless the bar/hosts/bussers are making a very good hourly which is unlikely other than for hosts) has or is expected to tip out.  It is likely somewhere around 2%-4% for the bussers/runners and bar, and sometimes hosts.  If she made $1000 in tips in 5 days, that means she is probably averaging about $1000 in sales each shift (assuming 1 shift a day and assuming she is being tipped about 20%; that comes out to $200 in tips each shift).  

$5000 in sales * .04 (4% standard tip-out) = $200 tipped out.

So no she didn't work for free.  She did the standard tip-out that is owed to bussers/hosts.  Every restaurant I've worked at does this.  Not sure what the problem is.  And if that waitress quit because she didn't understand how tip-outs work, then that is on her.  And no offense to your wife, how is she a manager and she doesn't understand that tipping out is a standard process?

Unless again there are some details that you are leaving out.  Is the tip out not going to the bussers or hosts?  If not then yes it is absolutely 100% illegal for a restaurant to just take money out of someone's check.  But I seriously doubt that is happening.  If it is then tell your wife to report it immediately.

I think there would be a lot more clarity if they didn't do tips by checks and simply did it at the end of the night w/ cash.  Because ultimately that tip out amounts to just about $40 each shift (again assuming 1 shift a day) which is absolutely standard.  And if you are working at a restaurant right now where you are able to rake in 180 (on average) after tip-out?  I'm not sure why you quit.  That is about as good as it is going to get in a restaurant right now with everything that has happened.

OFC lots of businesses operate in what should be an illegal way as well like those tip payouts for waiter/waitresses and the tip as a main income itself. My wife is a manager at a restaurant(not the GM) and had a waitress tip out 200 dollars  last week so she basically worked a day for free as that's around a good days of tips. Needless to say she put in her two week notice and my wife looked into the legality of it and it is perfectly legal as it doesn't sit well with my wife either who came up as a waitress as well.
 

I actually was not speaking out against organized labor. Unions are not perfect, have a sordid past but they also exist to protect workers by working in large groups. I have been around union and non-union skilled labor for going on almost 15 years now and I can tell you that for all the faults of the union, I understand the need for it. I have seen many workplaces, especially in the South, where the company just slowly steamrolls the work force because those people don't have the spine to work together for their own betterment. 

Unions exist to keep a balance of power. If it gets tilted too heavily in one direction or the other, it will completely destroy a workplace. Currently, the NFL has far too much of the power, IMO.

There are details left out for sure because I don't know the tip rate they are actually using and neither does she. This place is looking shady atm which is what got my wifes attention in the first place. They promoted her b/c she is the best worker there and the other manager quit.

Sure, but servers can't be the only ones who benefit from being tipped.  If servers are going to be tipped then the bar (although where I work, we don't tip out the bar but only because they make so much money off of togo) and bussers absolutely deserve to be tipped out too.  The job for servers would be 10x more difficult without a buster or two.  

So I get what you are saying but with the rules the way they are then I think it is absolutely fair for servers to tip out 4% of their sales.  I'm not saying that restaurant still isn't shady because most are, but I do think there is a fair explanation for why she had $200 taken out of her check based off the information you have given me.  And I do not think it is accurate to say that she worked for free.  Assuming 2 bartenders and 1 busser, that $40 tip-out each day is only $13 for each person.  And so even if every server in the restaurant is breaking $1000 in sales (and damn that's a productive restaurant if so) and you have 6 servers on the floor, that is $78 for each busser/bartender.  Compared to the 180 you as a server made that shift.  That is absolutely fair.

Like a usual guy I don't really care or ask her questions about the drama poo to be real with you. There were things she was looking at herself when she was only a server that I could respond with when she gets home. There was something else I just forgot what it was, a long time ago she was just like "at least pretend like you're listening that's all I want is to vent" b/c I used to just say to her I don't care about that drama poo and didn't get into it. Now I hear the drama poo but I am not really listening and 18 years going that is what my woman wants at least. 

This is the stuff that is mixed in with the usual drama when there are all female managers and you can come at me whoever you are that reads this with that sexist bullshit but you'd just be displaying your own ignorance as no one admits to it more than the actual women themselves. They know it's drama, you know it's drama, and I know it's drama. I just am an ear piece for it for her but took away some of that potentially odd stuff that could be illegal if she is the manager.
