I'm sitting in the ER was hit by a drunk driver, then tried to run me over.

He could at least put a "lean" on her. But a habitual drunk driver with nothing better to do than get blackout drunk on a Monday night prob doesn't have much going for her. Sadly, sometimes its more of a burden on the victim. I'd at least get a lawyer and have them do some digging. 

 

Yes, he could get a judgement and "lien" against any property she has....but again, not likely to amount to much.

 

The lawyer will take a look at her finances and balk at pursuing it if she does not have the assets to go after....they want paid too.

Similar thing happened to me about 10 years ago.  Dude rear ended me.  I was going about 40 (35mph zone)...he was going about 90.  Tore up the back of my car, spun me around in the road 2 or 3 times for about 1/10 of a mile.  He tried to drive off too, but I chased him down and called the cops.

lawyer and cop told my Dad the same thing when some drunk habitual felon drunkenly drove his or his mom's car (can't remember which) into my Grandpa's fence and did like $500 worth of damage. They said that he could put a lean on him, but the guy didn't have poo and it may not be in our family's best interest to be permanently linked to this dead beat over a project we could probably fix ourselves in a few saturdays.

 

a fence and a little cosmetic damage to the front yard are apples and oranges to a drunk driving accident and a doctor visit though is all I'm saying.

 

The last car I bought in college like 2009/2010, I bought it off a family friend and IIRC I couldn't buy the car off of him until he went to the courthouse and settled up with a lean someone put on him a few years ago.

I went to her bond hearing tonight and that just pissed me off, she allegedly speaks no English so she had a translator this bond hearing lasted over an hour. The judge set bond at $55,000 and if she makes bond she will be on house arrest. What pisses me off this is her 4th DUI other states call it a DWI anyway she should be denied bond as she clearly has no respect for our laws and our citizens. The judge also made her wear an alcohol badge thingy that checks every 30 minutes for alcohol. 

 

I also met her daughter who apologized to me several times, she was probably in her early 20's Latino and very friendly. The daughter then later during the bond tried to say her mom was not drunk she fled cause she didn't have a drivers license and drank when she got home...the judge told her to shut her mouth this was not a trial and save it for court..

 

Anyway I'm fine my neck is on fire and the headaches are constant but I'm alive and will survive.

It's her 4th DUI? Isn't North Carolina a three strikes state? Meaning fourth felony or DUI conviction (actually the third) and you face seriously elevated penalties (usually MUCH longer jail sentences). I am fairly certain that NC has a "habitual DUI" law that carries a mandatory one year prison sentence for those with three DUI convictions in ten years. I recall reading an article a few months ago about new legislation being introduced to actually reduce the threshold to two DUI convictions and eliminate the time requirement of ten years.

4th DUI Offense Fourth Drunk Driving Conviction

Blood Alcohol Content Under .10

  • Permanent License Revocation
  • Jail – Minimum 1 Year - Maximum 5 Years

Blood Alcohol Content .10 and Under .16

  • Permanent License Revocation
  • Jail – Minimum 2 Years - Maximum 6 Years

Blood Alcohol Content Above .16

  • Permanent License Revocation
  • Jail – Minimum 3 Years - Maximum 7 Years
