Hardy Case Dismissed

Keep in mind the state is claiming there was a settlement. They are the ones with egg on their face. No knows for sure if there was a settlement at all. She may have just bounced out of town because she was about to look foolish

If she was confident she would win the case, then she would have pursued it.  There would also have been a civil suit that followed (REGARDLESS OF THE VERDICT in criminal court) where she would get paid anyways.  The DA has nothing to lose making a claim they had "sufficient evidence" that there was a settlement.  That statement will never be looked into any further by anyone in the legal system.  It is basically the DA just trying to save face in a situation where they clearly had no case and drug it out much longer than necessary (in my opinion).

I've never posted any type of "sources" because I don't have any.But I have a good friend that is friends with her in Wilmington. Said she would get hammered drunk and coked out and brag to her friends about getting 200K for this. Also, said she is still in Wilmington and has been there for a while now. Not out of state or in islands like speculation.

Take it for what you will.

If he only paid 200k to make this headache go away I don't think you can take that as an admission of guilt but just a guy wanting this poo to be over

I don't know what a defendant would expect to get in a civil suit like this, but I imagine it would be significantly larger than that even with a not guilty verdict in criminal court unless it was proven that she pretty much had no case whatsoever.

Voth said they tagged him as a one year rental.  They never intended to sign him to a long term deal (too much risk).

 

Well the official word from both sides was that there was a negotiation on going. Were we just bluffing?

Said I'd be shocked if it was over five figures, but 200,000 is believable.... A woman as crazy and irresponsible as she seems to be will burn that to the ground in short order. Probably will spit her out on the other side at rock bottom.

I've been in civil and criminal court many times but that doesn't make me a lawyer so I'm going to ask the benevolent judges that sit in session on the huddle...

Two parties agreeing on a settlement (with no proof yet that they did) means fug all in a criminal case. Settlements are for civil cases. The DA can still press charges against Hardy, but the case was dismissed because their leading (only) witness has been a lying flake since before the bench trial even started so the DA knows that she can't be relied on to make a case?

Pretty much. Look at it this way, would you as a DA want to go you trial without your primary witness? It doesn't matter why she is a no show in the end, unless he killed her of course. Even if he paid her to disappear, which is illegal, she would have to still show up to testify to his coercion and bribery. She got what she ultimately wanted in money and revenge for dumping her. He got what he wanted by this all going away. Both parties happy so why prosecute him over a misdemeanor when all involved just want it to go away?

Ask yourself if you were in the same situation and they offered you say, $5 million. Would you take the money?

$5million?  Sure.  I just think the credibility of the DA's statement (which is the only thing I'm aware of that indicates there may have been a settlement) should be questioned severely.  I'm not accusing the DA of anything but keep in mind they are in a situation with all the reason in the world to try and save face and no consequences of doing so.
