Most states have a set precedent that treat it criminally as fraud under the argument that you didn't ever have an intention to pay to begin with.

I've owned and managed restaurants for 15 years, I've had to file charges on this before.

Refusal to pay is not the same thing as intent to defraud. If you stay and make a case to the establishment on why you should not pay, then this negates 'intent to defraud'. Know your laws. Know your rights.

And I believe you have filed police reports and used them as leverage in civil court. You may have even strong armed patrons who had no idea what their rights are in an act of commerce. I highly doubt you will point me to a criminal case of yours or anyone else that involved a patron being criminally charged due to refusal of payment because your restaurant was incapable of providing acceptable food and service based on what was advertised, agreed upon, or promised at the point of sale.

I am not even going into the 'mistake of fact' defense.

Also, in just about every state the type of criminal charge is dependent on the value of the food - including California.

The only loophole like this I can think of has to do with mainly hair salons. If you get your hair cut and they put no product in your hair or use anything like that, you can legally walk out without paying because you can't steal someone's time. You have to steal a tangible thing. Still though: don't do this.

Let's say you did write this report you can not reference. You know you would tell the person commissioning this report that it is worthless to pursue criminal charges up to a certain amount. What amount did you put in that report? Just curious.

Technically, the owner can press charges if they eat one bite and the food is adequate for human consumption. The patron can also press for legal action if your 8 ounce steak is 7 ounces. Both of them would get laughed out of any court by the judge.

 

This is about customer service and pleasing your patrons. Meanwhile, some of these posts I believe are from people in the industry and they are more worried about dine and dash/sticking it to their patrons who are dissatisfied with their establishment. Such a shame. My posts have nothing to do with dine and dash.

Glad we let him go because he didn't fit our scheme (downhill running, read-option), but he's perfect for Pittsburgh's scheme. Makes losing Bell not nearly as big of a deal.

D-Will has looked great tonight. A lot of people thought he was done when he left Carolina. He sure proved his critics wrong. I wish we had a rushing attack as effective as the Steelers have had tonight without having to rely on Cam to run the ball so much. He wouldn't have to take such a pounding every game and it would open up the passing game.

That offensive scheme is just too smooth. They love to trap and love to run a power blocking scheme. You can pretty much plug any JAG RB in that offense and they will go over 100. Todd Haley is a very good offensive coordinator.

I mean, you have to tip minimum wage right? I've done my time as a valet. I made $1.20 an hour so you bank on tips to get you to $9-10 an hour. Same for waitress. They make under $3/hour usually. They make their living off tips. You have to be somethin awful for me to not leave a good tip. Be real good and I personally throw you some more money

I can't help but wonder if the Panthers would run  the ball more effectively if we adopted a similar approach to the running game and drastically reduced or scrapped the read option.

But I've heard it said both ways.

Then kind of work I do requires me to tip all the time. Tipping  people for getting things done for me that isn't  neccesarrily their jobs or finding something that I may need. Hook me up... You get broke off

Talk to enough service folks and the things that people do in restaurants to dump on the staff is unbelievable.

There has been one time in my entire life when I didn't leave a tip.  Our server came to our table three times: once to take the order (after 15 minutes of waiting),  once to deliver the food, and once to deliver the check.  I watched him stand and talk to his coworkers for the entire time to only be interrupted by the occasional smoke break or to tend to another table (presumably for those same three things).  For the entire hour, I think I saw the guy put in 5 minutes of actual work.

I've seen bad service due to incompetence, emotional turbulence, understaffing (I actually tend to tip more in those cases), and the like.  I think on how much time I work to make X amount of money and tip accordingly.  Effort means something to me, personally.  Hence, the only time I ever went without tipping a single cent.
