Yeah breaking his phone does jack shite. They can still get all his calls and text.

Cell phone companies only track calls and texts, they can't get to any data he had locally in his phone. That's probably why he broke it.

They can also find his whereabouts around the suspected time of death. They can see what towers received his calls if any were made.

Texts are definitely stored. Go log into your account online and you can see them.

Who is your service provider. I have never been able to get texts.

I asked that question to not prove you wrong, but it would be a good thing to know in the future. In my experience, none of the providers captured and retained text messages. I really wished they did. If a carrier is now offering that feature that's awesome!

Damn. If I ever get murdered or somebody has to look at my text history and make it public, my family is gonna be like who the fug is this guy? I say that because 98% of my texts involve smack talk with my fantasy baseball league brethren.

Texts are most definitely recorded, and there have been many cases where investigators get court orders for them.  Off the top of my head, they have a bunch of texts from Trayvon Martin for example (possibly off his phone itself but I "think" it was from the carrier).
