In Nc it doesn’t matter if he had his seatbelt on or not. Shaq was at fault

I'm an attorney. The seat belt thing probably won't matter because it didn't cause the accident.  If Boone had actually done something that contributed to the cause of the accident his case would be a lot shakier. If he's just driving down the road and not wearing a seatbelt but someone crosses into his lane and hits him then he's not legally at fault for the accident.

The accident, no, I get that much. Wouldn't he have some liability for his own injuries since he didn't have a seatbelt on? It just seems to me he probably would have walked away with less severe injuries had that been the case. Just asking for clarification, if possible. Thanks in advance!

 

For example, it wasn't in an accident with another person (this is more about seatbelts) but I was being stupid when I was 22 and drove through the grassy separator through an apartment complex. I hit a barrier that I wasn't paying attention to at 10 mph. I ended up with two pinched nerves in my neck from head butting the windshield hard enough, when I came to a sudden stop, that I spidered the windshield. If I had my seatbelt on I would have been fine.

Seatbelt or no seatbelt it doesn’t matter. Shaq is at fault and Boone will most likely be awarded a hefty settlement
