wouldn't it fall under felony murder?

Now this happened in Texas, not North Carolina. Laws do differ by state.

For Aqib Talib to be charged with Murder they would have to establish intent. And unless someone comes forward or there is a recording of Aqib telling his brother to kill the coach it’s not gonna stick. And considering what has already transpired and the video itself, I doubt that’s gonna happen. It looks more to be a case of Talib’s Brother loosing his mind and shooting the coach for a heat of the moment decision.

there is a difference between planning an armed robbery where someone shoots someone and everyone gets charged with murder and then a fight breaking out and person decides to start shooting. Difference being intent, and one being a planned event while the other being a spontaneous event. And that’s what we are dealing with here.

if this was North Carolina, he would be charged with Misdemeanor assault, and Felony Inciting a Riot.

under NC law worst case this is a class F felony and definitely wouldn’t spend any time in jail/prison as a first time offender.

(ps. It’s incredibly hard to be sent to prison on a first time offense, in North Carolina you’d have to be charged with a Class D or higher to catch active time on a first time offense)

Depending on how/where you grew up having guys like that around you are essential. It’s just that once you make a better life for yourself it becomes less necessary. Kevin Hart’s movie True Story follows a similar theme.

Perhaps for someone that doesn't have a strong family. I've nearly always lived on the other side of the tracks (so to speak). My dad's peeps were known for violence to be perfectly honest, but only if you fuged with them. If your "friends" weren't right, they weren't tolerated (because they will bring you down).

He could be charged with felony murder if his commission of a felony led to a murder. Every state has that law.

Having friends you can count on in a scrap, or having friends that others fear is different than having a friend that uses their gun during a fistfight. And disconnecting from people like that is almost an impossibility.

I’d argue the threat of using the gun is what causes the person to be feared in the first place. fuged up situation regardless.

Yeah, but it's usually a case where someone plans a crime such as a bank robbery and someone else gets killed during the commission of said crime. For example, there was a case in my hometown where a jewelry store was robbed.  The owner pulled a gun and shot one of the would-be robbers.  The one that wasn't shot ran, but was caught, and charged with the death of his accomplice.  I don't know if he was convicted or not.

Getting in a fight, only to have someone you are with pull a gun and shoot someone normally doesn't lead to murder charges for the person getting in the fight.  Although I suppose it could if the prosecutor wanted to make a point.

As I explained in my other post that doesn’t exactly apply here, it wasn’t a felony until the coach got killed. It was just a misdemeanor assault Up and to that point.

and as I said before it would only be a felony under NC law. This happened in Texas and the laws do differ some state to state.

I know people don’t like Talib, I get it, I hated him as a football player too. But dude isn’t anywhere near guilty or responsible for murder. His brother is on the other hand.

there is a reason he has not been charged with murder and will not be charged with murder. So take it for what it’s worth.  Some on here need to separate the football player from the person.

I was planning to pie for the title alone, then I saw the video. If there is any justice, he pulls time.

I'm not a lawyer but isn't that accessory to crime at least?

I found this definition:

Accessory to a crime =

Being an accessory to a crime means that you helped the principal offender either commit a crime or get away with a crime. It is a very serious criminal offense. It is not necessary to plan in advance to be considered an accessory. You also do not have to know that a crime would occur or even be present for the crime committed.

He got it started. He started the attack and escalated it all. He's just as guilty for the murder.

100% he may not have pulled the trigger but started the whole damn thing.  Worst part the coach wasn't the one who made the call.  It was the referee.

What a sorry excuse for a role model.  You are coaching kids and this is how you freaking act.

I hope they lock him up for a long time.

And the inciting a riot charge would likely be dropped assuming he is a first time offender.  The brother deserves 20 to life.  Aquib should get some punishment as well.  But he definitely won't get murder.

20 to life? Are you fuging serious? He deserves the electric chair.

    • reading comprehension is hard. you even highlighted it, and still didn’t get it.
    • Yes because nothing happens in the offseason. What a masterful take. Thankfully all the football stuff happens from September to February. Wait didn't they just have something recently? Even an Injury and some contract drama? Nope, couldn't be. There is nothing happening at this time of year according to you.
